Infinium Capital Managment LLC Financial Stock Short Selling Disclosure

On September 21, 2008, the United States Securities and Exchange Commission issued an order that provided to market makers an exemption from the Commission’s prior temporary financial stock short selling ban. This Commission order (the “Order”) is available at http://www.sec.gov/rules/other/2008/34-58611.pdf and additional information about the Commission’s recent short selling orders is available at www.sec.gov. Pursuant to the Order, Infinium Capital Managment LLC will effect short sales as part of bona fide market making and hedging activity related directly to bona fide market making in (a) derivative securities based on Covered Securities (as defined in the Order), or (b) exchange traded funds and exchange traded notes of which Covered Securities are a component. As required by the Order, Infinium Capital Managment LLC hereby provides the following notice:

Pursuant to the Order, Infinium Capital Managment LLC may not knowingly effect a short sale as part of bona fide market making and hedging activity related directly to bona fide market making in a derivative security based on a Covered Security, if the customer’s or counterparty’s transaction will result in the customer or counterparty establishing or increasing an economic net short position (i.e., through actual positions, derivatives, or otherwise) in the issued share capital of a firm covered by the Commission’s temporary short selling ban.
